Terms of Service

Beunique Agency, operated by Beunique Labs Pvt Ltd (“Beunique”, “we”, “our”, or “us”), provides subscription-based growth services.

By subscribing to or using our services, you (“Client”, “you”) agree to these Terms of Service.

1. Overview of Services

1.1 Service Model

Beunique operates as a subscription-based growth agency, delivering ongoing services through structured systems rather than one-time projects.

 

1.2 Core Service Engines

Services are offered through three primary systems:

 

  • Authority Engine — Content, personal branding, and organic growth
  • Revenue Engine — Paid advertising, funnels, and lead generation
  • Product Engine — Branding, UI/UX, and high-converting websites

 

Clients may subscribe to individual engines or bundled plans.

 

1.3 Nature of Engagement

All services are delivered through a systemized workflow, prioritizing consistency, strategy, and long-term growth over ad-hoc execution.

2. Subscription & Billing

2.1 Subscription Plans

Services are offered on monthly, quarterly, semi-annual and annual subscription plans.

 

2.2 Auto-Renewal

All subscriptions automatically renew on the same billing date unless paused or cancelled.

 

2.3 Payment Processing

Payments are processed via:

 

  • Xflow (international clients)
  • Cashfree (India)

 

Managed through the client dashboard (Zoho).

 

2.4 Failed Payments

    • A 7-day grace period is provided for failed payments
    • During this time, services will be paused
    • If payment is not completed within 7 days, access may be restricted until resolved

3. Pause & Cancellation

3.1 Subscription Pause

  • Clients may pause their subscription at any time
  • Billing stops immediately upon pause
  • Limited to one pause per billing cycle

 

3.2 Cancellation

  • Clients may cancel at any time via the dashboard
  • Services will continue until the end of the current billing cycle
  • Cancellation does not result in refunds

4. Refund Policy

4.1 No Refunds

All payments made to Beunique are non-refundable.

 

4.2 Acknowledgement

By subscribing, you acknowledge that:

 

  • Services are ongoing and resource-based
  • Value is delivered continuously, not as a single deliverable

5. Scope of Services

5.1 Defined Scope

Each engine operates within its defined scope of services.

 

5.2 Plan Restrictions

  • Clients cannot switch between engines mid-subscription
  • Additional services require a separate subscription or upgrade

5.3 Strategic Execution

All work is executed based on:

 

  • Strategy
  • Priority
  • System alignment

6. Workflow & Delivery

6.1 Request System

  • Clients may submit multiple requests
  • Only one task is actively worked on at a time

6.2 Queue & Priority

Tasks are prioritized based on:

  • Strategic importance
  • Business impact
    (Not strictly on submission order)

6.3 Turnaround Time

  • Standard updates: 48–72 business hours
  • Complex tasks (e.g., websites): 7–10+ business days

6.4 Nature of Deliverables

Timelines may vary depending on:

  • Task complexity
  • Client responsiveness
  • Scope of work

7. Communication & Collaboration

7.1 Primary Communication Channel

All communication is conducted via ClickUp (official channel).

 

7.2 Calls & Meetings

  • Calls are not standard
  • Scheduled only when:

    • Strategy discussions are required
    • Client input is essential

7.3 Async Communication

Most collaboration is handled via:

  • Messaging
  • Loom/video explanations
  • Structured forms

7.4 Working Days

    • Operations run Monday to Friday
    • Services are delivered globally but executed from India (IST)

8. Revisions Policy

8.1 Revisions

  • Unlimited revisions are offered within scope

 

8.2 Finalization

    • Once a direction is approved, it is considered final
    • Reverting or changing direction may be treated as a new request

9. Fair Usage

9.1 Fair Usage Principle

All services are subject to reasonable and fair use.

 

9.2 Enforcement

Beunique reserves the right to:

  • Pause services
  • Restrict access
  • Terminate subscriptions

If usage is:

    • Excessive
    • Abusive
    • Outside reasonable operational limits

10. Client Responsibilities

10.1 Client Obligations

Clients agree to:

 

  • Provide timely feedback and approvals
  • Share necessary assets, access, and information
  • Communicate via official channels

10.2 Delays

Failure to provide timely inputs may:

 

    • Delay execution
    • Impact delivery timelines

11. Third-Party Costs

11.1 Exclusions

Subscriptions do not include:

  • Ad spend
  • Paid tools
  • Domains or hosting
  • External software or services

11.2 Responsibility

All third-party costs must be covered by the client.

12. Results & Expectations

12.1 No Guarantees

Beunique does not guarantee specific results, including:

 

  • Revenue
  • Leads
  • Followers
  • Conversions

12.2 External Factors

Outcomes depend on factors beyond our control, including:

  • Market conditions
  • Platform algorithms
  • Client execution

13. Intellectual Property

13.1 Ownership Transfer

Ownership of final deliverables transfers automatically after the delivery.

13.2 Retained Rights

Beunique retains rights to:

  • Unused concepts
  • Drafts and iterations

13.3 Portfolio Usage

Beunique may showcase completed work for:

  • Portfolio
  • Marketing

Exception:

White-label work remains strictly confidential.

14. Data & Access After Cancellation

14.1 Access Removal

Upon cancellation:

  • All system access is removed immediately

14.2 Client Responsibility

Clients must:

  • Download all deliverables before cancellation

14.3 Liability

Beunique is not responsible for:

  • Data loss after account termination

15. Account Access & Risk

15.1 Access

Clients may grant access to:

  • Ad accounts
  • Social platforms
  • Websites and tools

15.2 Risk Disclaimer

Beunique is not responsible for:

  • Account bans or suspensions
  • Platform policy violations
  • Third-party failures

16. Limitation of Liability

16.1 Exclusions

Beunique is not liable for:

  • Loss of revenue or profits
  • Ad performance or campaign losses
  • Indirect or consequential damages

16.2 Liability Cap

Total liability is limited to:

17. Termination

17.1 Termination by Beunique

We reserve the right to terminate services if the client:

  • Violates these Terms
  • Fails to make payment
  • Engages in abusive, unethical, or uncooperative behavior

17.2 Effect of Termination

  • Services cease immediately
  • No refunds will be issued

18. Governing Law

These Terms are governed by the laws of:
Chh. Sambhajinagar (Aurangabad), Maharashtra, India

19. Updates to Terms

Beunique may update these Terms at any time.
Continued use of services constitutes acceptance of updated Terms.
